The Case of the jet-setting tuberculosis patient Andrew Speaker.
Has raised the spector of Federaly (CDC) imposed Quarantine.
His quarantine was not approve by a judge, but rather issued under the CDC's administrative powers. (contact for reference)
A CDC offical said Speaker had the right to request an administrative
hearing to appeal the quarantine order.
The legal rights of a quarantined person, including the right to
request an hearing, are not clear under current law.
What are the legal rights of a quarantined person,city or county?
With the an outbreak of of pandemic flu on the horizon.
How do I know that a quarantine order is legal? or benefical?

This is a topic that will require more research. Historically the CDC has had virtual authority in cases of pandemic or epidemic outbreak. With the threat of biological terrorism their roll will continue to increase. Regardless we have to be aware and take care of ourselves and be proactive when need be. There have been more than a few times that I have been sitting on a plane and someone is hacking away behind me. Crowded enclosed areas like aircraft that continually recalculate the existing air are dangerous places to our health. I am starting to see more people, usually Asian, wearing masks while flying. This may not be much of a fashion statement but is a good idea to at least have in your carry on in case someone is coughing up a lung two rows back.
The world is a changing place. Government entities like that of the CDC, FDA, etc have rolls that will evolve and I don’t see them getting any less authorative or losing any power that they now have.

I am starting with the assumption that quarantine is a lawful act.
When one is quarantined the quarantiner should provide medical
care. |

The person a few rows back should be the one wearing the mask.
So the micro particles with germs on them will be captured by the mask.
The flight crew should insist on this and you should.
Wearing a surgical mask in this situation is much less effective than
wearing a half or fullface respirator. respirator is the key word here.
Remember that a Human can catch a cold through our Eye /tear ducts.
Cheers! to getting that CBRN filter through security.
Although it should be no problem, it is not on the TSA list of
prohibited items.
Nor should it! |

Naaw, see what you do is just yell SNAAAAKE! and as everyone panics and jumps on their seats and stuff, take the opportunity to beat down on sickley boy and drag him into the John or something.

Wear your Scott Promask 40 on a three hour plane ride and you will probably make the six oclock news. The lttle face masks are so easy to carry you could be nice and hand them out, including the hacker. All I know is I don't have time for someone elses virus even if its just a cold. But although I am starting to see others wear a mask on a plane I havent packed any yet. You're right, if the airlines would pass them out by request then wearing them would be much more accepted.

| The trouble is a surgical mask does not provide you with protection. They are not form fit and do not block all germs from entering through them. They mainly prevent the wearer from breathing directly on you and trap moisture particles from traveling. If the mask is moist (breath condensation) then germs can travel through the mask. A N-95 mask, with fit test is what you need to prevent airborne contamination from getting into your lungs. Remember, many pathogens can be transmitted by other means. Contact with surfaces, airborne, through direct contact , ingestion, etc. One of the easiest and best ways to stay healthy is simply wash your hand for at least 1 min. More hints if you are interested. |

All good info Mark, keeo it comming. I agree that the hands are key. We are always shaking hands and grabbbing the same knobs and handles thet the infected grab, then before you know it we are rubbing our eyes or picking our teeth. We need to keep the hands clean of viruses as well as our mucas membranes.
